The Orth Kluth ‘Logistics Projects and Outsourcing’ specialist team provided comprehensive legal advice to the BestSecret Group in connection with the development of a new customer order fulfilment centre in Sulechów, Poland.

BestSecret is a leading European members-only online destination for premium and luxury off-price fashion based in Aschheim near Munich.

The new fulfilment centre will significantly increase BestSecret’s logistics capacity. It will be around 90,000 square metres in size and is scheduled to commence operations in spring 2023. This is the most significant logistics investment project that the BestSecret Group has ever implemented.

The fulfilment centre is being constructed by Panattoni, one of the leading logistics property developers in Europe, on a built-to-suit basis for BestSecret Poland Sp. z o.o. BestSecret has signed a long-term commercial lease with Panattoni for the logistics property in Sulechów, Poland. During the lease negotiations BestSecret benefited from the legal advice of JDP Drapala & Partners, an Orth Kluth partner law firm in Poland. Orth Kluth also supported the lease negotiations, providing legal advice to BestSecret on strategic, cross-project and international issues.

When the fulfilment centre has been built BestSecret will install comprehensive technical equipment (including pick towers and pocket sorters). Orth Kluth is providing legal advice to BestSecret on the procurement of the technical equipment. It has also drafted procurement contracts and is currently in the process of negotiating with vendors.

BestSecret has engaged a leading international logistics service provider to manage the fulfilment centre on the basis of a long-term master agreement. Orth Kluth drafted this logistics master agreement and negotiated with (initially several) logistics service providers.
