Construction Law – Comment on the BGH ruling of 9 November 2023 – VII ZR 190/22
In its ruling of 9 November 2023 (VII ZR 190/22), the Federal Court of Justice confirmed that architects are liable if they provide legal services improperly and the client suffers damage as a result.
Specifically, the case concerned a construction contract that an architect had provided to the client. The contract contained a discount clause which the architect had formulated and which was invalid under general terms and conditions law.
