Together with the German Institute for Legal Departments and Company Lawyers (diruj), we cordially invite you to our online seminar. The “correct” assessment of works council remuneration under works constitution law was and is complex, just think of the legally very limited promotion opportunities for exempted works council members or the legality of shift allowances. Nevertheless, the situation for employers became even more complicated at the beginning of 2023, and works council remuneration has become a compliance issue: This is because the Federal Court of Justice has ruled that the payment of excessive remuneration to works council members not only constitutes a breach of the ban on favoritism under works constitution law, but can also constitute the criminal offense of breach of trust. This has given the issue of works council remuneration a criminal dimension, which should prompt companies to scrutinize the remuneration of works council members. In response to the Federal Court of Justice’s decision, the legislator has now introduced a draft law to revise works council remuneration, which is intended to provide opportunities for a more legally secure structure.
