Regulatory Law

Our Regulation team advises transport companies, infrastructure operators, public authorities and industrial companies on various regulatory issues. On behalf of ministries at federal and state level, we are involved in legislative projects as independent external consultants and have prepared numerous position papers over the years.

The regulatory focus of our advice is on local public transport and regulated rail markets (passenger and freight transport). We offer solutions at the interface of regulatory law, antitrust law and contract law. We complement our forward-looking advice with active representation of our clients before authorities and, if necessary, in court.

We advise public transport companies on all legal issues relating to market access, such as route concessions and the awarding of transport contracts. We advise public transport authorities and transport associations on passenger transport law, public procurement law and state aid law. We help with the conclusion of tariff and distribution cooperations. We are just as familiar with infrastructure usage fees (routes, stations) as we are with energy procurement, including the use of alternative drive systems.

We advise players in the rail freight sector on all issues relating to network access, in particular on the regulation of charges and train path allocation as well as in cases of discrimination against private rail transport companies. We conduct proceedings for our clients before the Federal Railway Authority, the Federal Network Agency and the Federal Cartel Office and assist them in enforcing or defending against regulatory claims. We draft and review terms of use for both the rail network and transport-related service facilities.

In the field of electromobility, we support our clients with our cross-practice group teams – whether in regulatory, construction, contractual or energy law issues.
